In most situations, if you win your appeal, you case will be “remanded.” This means the case will be sent back to the trial court or judge responsible for your conviction and/or sentencing.
An appeal is a review of the trial court’s application of the law. There is no jury in an appeal, nor do the lawyers present witnesses or, typically, other forms of evidence. The court will accept the facts as they were revealed in the trial court, unless a factual finding is clearly against the weight of the evidence. Thank you for subscribing!
If you win a sentence appeal, the court will re-sentence you. Before you are re-sentenced you get the chance to put new evidence in front of the court (mostly to bring the court up-to-date about what is happening in your life) which the court will take into account when re-sentencing you.
Who can appeal ? Anyone who has been convicted or sentenced in the District or Supreme Court can appeal their conviction and/or sentence. Technically, for most indictable appeals, you need the permission of the Court of Criminal Appeal to appeal.
