The court allowed the Government to introduce evidence of Katz’s end of the telephone conversations, as the FBI had attached an electronic listening device outside the phone booth. Katz claimed that the recordings were obtained in violation of the Fourth Amendment, but the Court of Appeals rejected his claim. It then granted certiorari, which is the highest court in the land.
